Terms and Conditions
Last updated: October 16, 2026.
1. Identification and scope
GMS Creativo is the trading name of Guillermo Manuel Sira Ortiz. Its activities consist of two business lines: downloadable WordPress plugins and their licenses, and professional agency services. These terms govern the use of gmscreativo.com and purchases within each business line under their specific conditions. All requests, support enquiries, complaints, claims and refund requests addressed to GMS Creativo must be sent exclusively to agencia@gmscreativo.com. Website contact forms are not used for those processes. The conditions of each product listing or accepted quotation supplement these terms without reducing mandatory rights.
2. Software products and purchasing
The software offering will comprise downloadable WordPress plugins, free or paid, with or without a commercial license key as stated in each listing. Not every plugin requires a subscription or paid activation. Before purchase, the listing will show the plugin description, included features, technical requirements, applicable limits, price, currency, taxes and, where relevant, duration, billing frequency and renewal terms. Open-source licenses retain their own conditions, whether or not a commercial key exists.
3. Paddle and other services
Where the checkout identifies Paddle as the authorized reseller and Merchant of Record, Paddle manages that transaction, payment, applicable taxes and purchase receipt. Its Buyer Terms also apply. GMS Creativo develops the product and provides the support offered. The seller identification and checkout terms determine who makes the sale.
GMS Creativo uses Paddle exclusively to sell downloadable WordPress plugins and software licenses. Graphic design, website design and custom development, consulting, migration, hosting and maintenance services are contracted separately under a quotation and paid through other payment methods. These services are not sold or charged through Paddle. Their appearance on this website does not make them part of a software purchase through Paddle.
4. Orders, prices and delivery
Customers must provide correct information and have the capacity to contract or authority to represent their business. The final price and billing frequency must be known before confirming the order. Price changes do not apply retroactively to paid periods; renewal changes will be communicated as required by law and the contract. Once payment is confirmed, digital delivery takes place through the stated channel: download, email, account or activation. If you do not receive access, contact support with your order identifier without sending complete card details.
5. Subscriptions, renewals and cancellation
Plugin or license subscriptions renew automatically only where disclosed and accepted during purchase. All cancellation or assistance requests addressed to GMS Creativo must be sent to agencia@gmscreativo.com. Buyers retain the self-service options provided by Paddle in their receipt or portal. Cancellation normally preserves access until the paid period ends and does not itself produce a refund. On expiry, updates, support or features requiring an active license may cease according to the plugin listing, without authorizing deletion of customer content. These software rules do not determine the conditions of agency services.
6. Professional services
The agency business line includes website design, custom development, maintenance, graphic design, consulting, hosting, domains, migrations and any other contracted professional service. These services are provided outside Paddle and governed by the accepted quotation or contract: scope, deliverables, revisions, deadlines, price, deposits, payments, cancellation and settlement. No commercial refunds are offered except as expressly provided in those conditions, without prejudice to mandatory legal rights. The plugin and license refund policy does not apply to these services, regardless of the agreed payment method. Additional work requires prior agreement, and deadlines may depend on customer materials and approvals.
7. Licenses, authorized use and intellectual property
The Software License Terms apply exclusively to downloadable WordPress plugins and associated commercial benefits included in their listing; they do not govern agency services. Open-source licenses, including the GPL where applicable, retain their rights and prevail over incompatible restrictions. Customers retain ownership of their data and materials. Unauthorized website access, fraudulent sharing of commercial keys and infringement of third-party rights are prohibited.
8. Operation, backups and support
Technical requirements, features and support scope will be stated in each plugin's listing and documentation. Compatibility also depends on WordPress, hosting and other installed components. Before installing or updating a plugin, customers should check its requirements and keep an appropriate backup. Plugins are not represented as having features absent from their description. These conditions do not exclude any enforceable obligations concerning conformity, repairs or liability.
9. Refunds and consumer rights
The Refund Policy covers only paid plugin and license purchases through Paddle. Its commercial 10-day request period does not apply to agency services, which are governed by their accepted quotation or contract. No general refund guarantee is offered for those services. All requests must be sent to agencia@gmscreativo.com. Mandatory legal rights, remedies for defects or non-conformity and decisions falling within Paddle's responsibilities remain in force. Downloading a plugin does not itself remove a withdrawal right without the necessary legal requirements being met.
10. Liability, suspension and changes
We may take proportionate action against fraud, security risks or material breaches, providing notice and an opportunity to remedy matters where appropriate. Liabilities that cannot lawfully be limited are not excluded. We are not responsible for failures caused exclusively by third parties or use contrary to instructions, without prejudice to our own applicable obligations. Changes to these terms will be dated and will not retroactively reduce acquired rights. If a clause is invalid, the remaining clauses retain effect to the extent legally permitted.
11. Privacy and dispute resolution
Data processing is explained in the Privacy Policy. All requests, complaints or claims addressed to GMS Creativo must be sent exclusively to agencia@gmscreativo.com; contact forms do not handle these processes. The parties will seek to resolve issues through this channel without limiting access to authorities, courts or legally recognized complaint procedures. Applicable law will govern, together with Paddle's terms as seller for software purchases made through Paddle.
