Privacy Policy
Last updated: October 16, 2026.
1. Controller and scope
GMS Creativo is the trading name of Guillermo Manuel Sira Ortiz. This policy describes the processing of data on gmscreativo.com for its two business lines: downloadable WordPress plugins, with or without a commercial license, and professional agency services. All privacy requests, support requests, complaints, claims and refund requests addressed to GMS Creativo must be sent exclusively to agencia@gmscreativo.com. Website contact forms and support panels are not used to handle these processes.
2. Data we process
Depending on your relationship with us, we may process your name, business, email address, telephone number and billing information; the content of enquiries and support requests; orders, payments, subscriptions and refunds; license identifiers and status, activated domains, plans and software versions; and technical information necessary to deliver and protect the service, such as IP addresses, access logs, versions and errors. Do not send sensitive data or credentials that are unnecessary for your request.
3. Purposes and legal bases
We use data to answer enquiries and prepare quotations, perform contracts, deliver software and licenses, manage subscriptions and provide support. We retain information required by accounting and legal obligations. We may process limited data to prevent fraud, protect systems and defend claims based on legitimate interests where applicable, after considering individuals' rights. Marketing communications and technologies requiring consent will only be used with a valid legal basis; withdrawing consent does not affect earlier processing.
4. Payments through Paddle
Paddle is involved exclusively in paid WordPress plugin and license sales where the checkout identifies it as the authorized reseller and Merchant of Record. It processes purchase data under its own Privacy Policy. GMS Creativo receives the data needed to deliver the plugin, manage any applicable license and assist the buyer, without receiving complete card details entered directly into Paddle. Agency services are contracted and charged separately under their quotation; Paddle does not process their payments merely because those services appear on this website. Other payment providers process the information they need under their own terms.
5. Connected websites, files and backups
Plugins and maintenance services may require technical information and authorized access to files or databases to perform a requested function. Using a management tool does not mean that all website content is sent to GMS Creativo: processing and backup storage depend on the product and its configuration. Each product's documentation explains its external communications. The customer must be authorized to manage those websites and data. Where we act as a data processor, the appropriate terms will be established before accessing data on the customer's behalf.
6. Recipients and international transfers
Hosting, email, infrastructure, security and support providers may be involved, with access limited to what is necessary, as may authorities where legally required. We do not sell personal information for third-party advertising. Where processing involves international transfers requiring legal safeguards, the appropriate mechanisms will apply, such as adequacy decisions or valid contractual clauses. Third parties acting as independent controllers follow their own privacy policies.
7. Retention and security
We retain data throughout the business relationship and subsequently for the periods necessary to meet legal obligations or address liabilities. Enquiries that do not lead to a contract are retained only as needed to manage them and carry out legitimate follow-up. Once no longer needed, data will be deleted, anonymized or restricted where appropriate. We apply access, confidentiality and protection measures appropriate to the risk; no connected system guarantees absolute security. Do not publicly share a license key or password.
8. Cookies, local storage and external content
The website may use technologies necessary for sessions, security or preferences. The landing page editor uses local storage to save browser settings, and the language selector may remember your language preference. Analytics or advertising technologies requiring consent will not be installed before obtaining it. Third-party videos, when enabled and opened, may connect to their provider. You can manage permissions and storage in your browser; blocking necessary functions may affect the service.
9. Rights and complaints
Depending on applicable law, you may request access, rectification, erasure, objection, restriction, portability and withdrawal of consent by writing exclusively to agencia@gmscreativo.com. Specify the right you wish to exercise; we may request proportionate identity verification. Website contact forms are not the designated channel for these requests. This does not limit any mandatory legal rights or methods of exercising them. You may contact the competent authority, including Spain's AEPD where applicable. Technical license validation does not in itself constitute automated decision-making with legal or equivalent effects.
10. Minors and updates
Our offering is intended for people with the legal capacity to contract and for professionals and businesses. We do not deliberately request information from minors without any required authorization. This policy may change to reflect developments in the service or legal requirements. The date will be indicated and material changes communicated when required.
