Software License Terms

1. Licensor and products
These terms govern exclusively downloadable WordPress plugins from GMS Creativo, the trading name of Guillermo Manuel Sira Ortiz. Each listing will state whether the plugin is free or paid and whether a commercial key or license is required; not every plugin needs commercial activation. Applicable open-source licenses retain their own rights. Website design, development, maintenance, graphic design, consulting and other agency services are outside these terms and governed by their quotation or contract. All plugin or license requests addressed to GMS Creativo must be sent exclusively to agencia@gmscreativo.com, without using website forms or support panels.
2. Open-source and third-party rights
Components subject to the GPL or other open-source licenses are governed by those licenses. These terms do not restrict their permissions to use, study, modify or distribute software, or replace their notices or requirements. Commercial limits on activation, updates, support and hosted service access do not remove rights granted under an open-source license. The following clauses apply only to the extent compatible with each component's license and applicable law.
3. Commercial rights and plans
Only where a plugin listing includes a commercial license or plan does the purchase provide non-exclusive access to the stated benefits for the contracted period. The listing will describe applicable limits, duration, features, updates and support. A free plugin or one distributed without a commercial key is not required by these terms to subscribe to a paid plan. Purchase does not transfer ownership of the provider's trademarks, documentation or infrastructure, or change open-source permissions. Plugin-related benefits are distinct from the agency's professional services.
4. Activation and validation
Paid services may require a key and periodic validation to check validity, plan, activations and domain. Necessary information may include a license identifier, version and limited technical data, under the Privacy Policy and product documentation. This does not grant general authority to inspect private content unrelated to the requested function. Commercial keys must remain confidential.
5. Professional use and client websites
Where the plan allows it, you may use the product on client websites with sufficient authorization. The commercial license remains associated with its holder unless a transfer is authorized. Test environments are excluded from limits only if the product states this. Deactivation allows an activation to be reused only where the function and plan permit it. Remote service limits must be respected without falsifying domains or using stolen or fraudulently shared keys.
6. Updates, support and compatibility
Entitlement to plugin updates and support depends on its listing and, where applicable, an active plan. Support requests must be sent exclusively to agencia@gmscreativo.com; website contact forms and panels are not used to handle them. Plugin support does not automatically include design, development, maintenance or other agency work. Customer modifications may require further diagnosis without restricting GPL permissions. Indefinite compatibility with all versions of WordPress, PHP or external services is not promised.
7. Operating environment and customer data
Each plugin may be used only for the functions described in its listing and documentation. Users must be authorized to install it on the website and process data necessary for its operation. Before installation, updates or configuration changes, users should review requirements and maintain an appropriate backup. Not all plugins are assumed to manage websites, create backups or provide external services. Customer content and data remain their owner's property. License management does not authorize their deletion.
8. Trademarks, distribution and hosted services
Notices required by applicable licenses must be retained. Open-source distribution rights do not confer trademark ownership or authorize presenting a modified product as an official GMS Creativo release. Nor do they automatically include third-party commercial keys or access to the provider's hosted services. Reverse engineering or interoperability permitted by a license or mandatory law is not prohibited by this agreement.
9. Duration, expiry and refunds
Where a plugin includes a commercial license or subscription, its duration, renewal and expiry effects are those stated at purchase. Renewals are automatic only if disclosed and accepted. The Refund Policy applies exclusively to paid plugins and licenses sold through Paddle, subject to individual assessment without an automatic refund guarantee. Agency services are excluded and governed by their quotation or contract. All cancellation or refund requests addressed to GMS Creativo must be sent to agencia@gmscreativo.com. A full refund may cancel the key and associated commercial benefits, respecting open-source and mandatory legal rights.
10. Breach, liability and changes
Fraud, leaked keys or material breaches may lead to proportionate suspension of commercial services, with notice and an opportunity to remedy matters where appropriate. Suspension does not remove independent open-source rights. Warranties, remedies or liabilities that cannot lawfully be limited are not excluded. Changes will not retroactively reduce acquired rights and will be communicated when required. Mandatory law and the competent courts for each contractual relationship will be respected.
